We LOVE your fanart of our projects! We are constantly in awe of and inspired by our incredible creator community.

That said, at the end of the day, we are a business. The characters and worlds we create go toward sustaining our studio and our employees’ livelihoods. This enables us to continue to create more projects and games for everyone to enjoy.

We recognize the skill, passion, and effort that go into creating fanart. And as artists ourselves, we understand that artists need to make money to sustain themselves. We want to acknowledge this reality by setting out this formal policy for what we will usually permit as far as creating and selling art derived from our intellectual property.

Heart Machine will typically permit the sale of merchandise derived from our copyrighted works (characters, art, SFX, writings, etc.) if the following conditions are met:

1. You obtain express permission from Heart Machine to proceed with selling specific products on specific platforms.
   1. Any subsequent change in product design or sale / promo platform will require you to ask for and receive permission again.
   2. Note that we are not able to review every submission, and submitting anything to the submissions email will not be considered a submission of an idea for consideration to Heart Machine; Heart Machine creative teams will not review your submission and - if it is reviewed at all - it will be reviewed only to ensure compliance with this policy and that it will not bring Heart Machine or others any ill will, disrepute or harm.
   3. By submitting materials to Heart Machine, you recognize that other persons, including Heart Machine, may have made or may in the future originate similar or identical ideas, concepts, or materials that Heart Machine may have the right to use, and you understand that you will not be entitled to any compensation because of Heart Machine's use of such similar or identical ideas, concepts, or proposals in any manner. You acknowledge that by submitting materials to Heart Machine, you waive the right to make any claim against Heart Machine arising out of or connected with the materials submitted to Heart Machine or Heart Machine's intellectual property.
2. You agree to sell only direct to consumer (no wholesale, B2B, or resale) and only in small, limited quantities (<100 items).
3. Your advertisements, listings, marketing copy, and any product descriptions make it prominently clear that this is neither official Heart Machine merchandise, nor sponsored by Heart Machine, and is 3rd party fan-made merchandise.
4. Your work must be original except to the extent it is derived from our work (that is: don’t copy others’ works) .

We hope this common sense policy is clear, fair, and realistic. To submit a request for permission to sell your work, please write an email to [email protected] and provide the following information:

1. Subject Line: Heart Machine Fan Merch - Permission Request
2. An attachment file or pasted image of the artwork you would like to be sold.
3. A link to the store page / platform where you would like it will be sold. (ex: Redbubble, Vistaprint, etc.)
4. Links to social media or other sites where you would be promoting your work if approved.
5. Marketing and product description copy.

If you have multiple works, please provide the above for each item.

Heart Machine reserves the right to decline to grant permission of the sale of any items derived from our intellectual property, with or without reason.
